High Court Clears Rivers State Electoral Commission to Conduct Local Government Elections on October 5

In a significant ruling, the Rivers State High Court has granted the Rivers State Independent Electoral Commission (RSIEC) the clearance to proceed with conducting the forthcoming local government elections on October 5, 2024. The court's decision marks a crucial step towards ensuring democratic processes at the grassroots level in the state. The ruling, which came in response to a suit filed by the Action Peoples Party (APP), reaffirms the authority of RSIEC to organize and oversee the local elections despite challenges brought forward by the Plaintiff.

Court Ruling on Suit No: PHC/2696/CS/2024

The judgement was delivered by Justice I. P. C. Igwe, presiding over the case with Suit No: PHC/2696/CS/2024. The Action Peoples Party (APP), acting as Plaintiff/Applicant, had filed the suit against RSIEC, the Rivers State Government, and the Governor of Rivers State, who were listed as the 1st to 3rd Respondents, respectively. The APP sought to challenge the legality of the scheduled elections, raising concerns about the preparedness and impartiality of RSIEC in conducting the elections.

However, after reviewing the arguments presented by both sides, Justice Igwe ruled in favor of the electoral body, the state government, and the governor. The court found that RSIEC has the legal mandate to conduct the elections, dismissing the objections raised by the APP.

RSIEC’s Mandate Affirmed

Justice Igwe’s ruling reaffirmed that RSIEC, as an independent electoral body, has the authority to conduct elections at the local government level. This decision underscores the commission's capacity to carry out its constitutional responsibilities, ensuring that local government leadership is democratically elected.
